David Duncan was born in Medford, Oregon in 1951. He attended the United World College of the Atlantic in Wales for two years, then attended Columbia University as a John Jay Scholar, graduating magna cum laude and Phi Beta Kappa in 1973. He was a graduate student in linguistics at the Massachusetts Institute of Technology from 1974 to 1978. He received his J.D. magna cum laude from the University of Pennsylvania Law School in 1982, where he was Article Editor for the Law Review. Mr. Duncan served as a law clerk for Judge Edward R. Becker of the Third Circuit Court of Appeals in Philadelphia and practiced as a civil litigator and commercial real estate lawyer in Philadelphia before coming to Boston and joining Zalkind, Rodriguez, Lunt and Duncan in 1985.

He practices in both state and federal courts at the trial and appellate level, and has tried or been co-counsel on numerous major criminal cases. Mr. Duncan also has a significant civil practice. He represents students, faculty and employees in university disciplinary proceedings, and he and John Ward successfully challenged restrictive city entertainment regulations that violated the first amendment. He has also represented clients in civil fraud, personal injury and civil rights actions.

Mr. Duncan is a contributing author to Massachusetts Criminal Defense, edited by Eric Blumenson and Daniel Kanstroom. He has taught in the clinical program at Suffolk University Law School, and regularly teaches in the Committee for Public Counsel's Bar Advocacy training program. He is a member of the bar in Massachusetts and Pennsylvania and a member of the Massachusetts and National Associations of Criminal Defense Lawyers.
